This Agreement is a legally binding contract between you ("User", "you", or "your") and Swasth Care ("Company", "we", "us", or "our"). By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Swasth Care is strictly a healthcare information and patient facilitation platform. We are not a hospital, medical clinic, or healthcare provider. We do not employ doctors or medical staff, and we do not provide medical advice, diagnosis, or treatment directly.

1. Acceptance of Terms

By accessing our website, booking a consultation, or using any services provided by Swasth Care, you agree to comply with and be bound by these Terms. If you do not agree to these Terms in their entirety, you must actively stop using our Platform and services immediately.

We reserve the right to update, change, or replace any part of these Terms at our sole discretion. It is your responsibility to check this page periodically for changes. Your continued use of the website following the posting of any changes constitutes acceptance of those changes.

2. Description of Services

Swasth Care operates as a facilitator connecting patients with independent third-party healthcare providers ("Partner Clinics"). Our services include:

  • Providing educational content regarding hair transplants, skin treatments, and cosmetic procedures.
  • Facilitating communication between users and verified specialists.
  • Scheduling initial consultations (often free of charge) on behalf of the user.
  • Assisting with logistical coordination for treatment planning.

Scope of Role: Our role is limited to that of an aggregator and facilitator. We are not a party to the medical contract between you and the Partner Clinic.

3. Medical Disclaimer & No Professional Advice

No Doctor-Patient Relationship: Use of this Platform does not create a doctor-patient relationship between you and Swasth Care.

Informational Purposes Only: Content on this Platform, including text, graphics, images, and other material, is for informational purposes only. It is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

  • Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.
  • Never disregard professional medical advice or delay in seeking it because of something you have read on this Platform.
  • Swasth Care does not endorse any specific tests, physicians, products, procedures, or opinions mentioned on the Platform. Reliance on any information provided by Swasth Care is solely at your own risk.

4. User Eligibility & Responsibilities

By using our Platform, you represent and warrant that:

  • You are at least 18 years of age and legally capable of entering into binding contracts.
  • All registration information you submit is truthful, accurate, and complete.
  • You will maintain the accuracy of such information.
  • Your use of the Platform does not violate any applicable law or regulation.

You agree not to use the Platform for any unlawful purpose, including but not limited to submitting false medical histories, impersonating others, or attempting to compromise the security of our systems.

5. Relationship with Partner Clinics

Swasth Care connects you with independent Partner Clinics. While we employ a rigorous verification process (checking credentials, facilities, and track records), the following applies:

5.1. Independent Contractors

Partner Clinics and their doctors are independent contractors and not employees, agents, or partners of Swasth Care. We do not exercise control over their medical judgment or clinical procedures.

5.2. No Guarantee of Results

Medical and cosmetic procedures carry inherent risks. Swasth Care does not guarantee specific results or outcomes. Results vary based on individual physiology. Before-and-after photos on our site are illustrative and do not constitute a warranty of results.

5.3. Liability for Medical Services

Swasth Care is not liable for any medical negligence, malpractice, injury, side effects, or dissatisfaction arising from treatments performed by Partner Clinics. Any claim or dispute regarding the medical treatment must be directed solely against the Partner Clinic and the treating physician.

6. Financial Terms & Cancellations

  • Facilitation Fees: Unless explicitly stated otherwise, Swasth Care's consultation booking service is free for patients. We may receive a facilitation fee from Partner Clinics.
  • Treatment Payments: All payments for medical procedures, surgeries, or medications are made directly to the Partner Clinic. Swasth Care does not collect payments for medical services.
  • Refunds: Refund policies regarding treatment deposits or procedure costs are governed exclusively by the Partner Clinic's terms and conditions. Swasth Care is not responsible for processing refunds for medical services.

7. Intellectual Property Rights

The Platform and its original content, features, and functionality (including but not limited to the "Swasth Care" name, logo, design, text, graphics, and software) are owned by Swasth Care and are protected by Indian and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any of the content on this Platform without our express prior written permission.

8. Privacy & Data Protection

Your use of the Platform is also governed by our Privacy Policy. By using the Platform, you consent to the processing of your information (including sharing necessary medical details with Partner Clinics for consultation purposes) as described in our Privacy Policy.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SWASTH CARE, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THIS PLATFORM OR ANY TREATMENT OBTAINED THROUGH A PARTNER CLINIC.

10. Indemnification

You agree to defend, indemnify, and hold harmless Swasth Care and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

11. Governing Law & Jurisdiction

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or invalidity thereof shall be settled by the competent courts located in New Delhi, India.
